Terms of Service

1. Agreement

By creating a Recruix account or using the Recruix platform, you agree to these Terms of Service on behalf of yourself and your organisation. These terms form a binding agreement between you and Business Made Safe Holdings (Pty) Ltd (“Recruix”, “we”, “us”).

2. Permitted use

Recruix may only be used for lawful recruitment and HR purposes. You may not:

• Process candidate data without the candidate's consent as required by POPIA.
• Use the platform to discriminate unlawfully in contravention of the Employment Equity Act.
• Attempt to access another tenant's data or circumvent access controls.
• Reverse-engineer, copy, or resell the Recruix platform or its AI outputs.

3. Subscriptions and billing

Recruix is offered on a monthly subscription basis. Pricing is in South African rand (ZAR) and is billed via PayFast. Subscriptions renew automatically unless cancelled before the renewal date.

We reserve the right to change pricing with 30 days' notice to the account administrator. Continued use after the notice period constitutes acceptance of the new pricing.

4. Your data

You retain ownership of all data you upload to Recruix. By uploading candidate CVs, you represent that you have the candidate's consent to process their personal information as described in our Privacy Policy.

We process your data as described in the Privacy Policy and in accordance with POPIA. We do not sell your data to third parties.

5. AI-generated content

Recruix uses AI to extract candidate information and generate shortlisting recommendations. AI outputs are provided as tools to assist your decision-making — they are not binding assessments and should not be the sole basis for employment decisions. You remain responsible for all hiring decisions.

6. Service availability

We aim for high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from service interruptions.

7. Limitation of liability

To the maximum extent permitted by South African law, Recruix's liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages.

8. Termination

Either party may terminate the agreement at any time. On termination, your access to the platform ceases and your data will be deleted within 30 days in accordance with our Privacy Policy.

9. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of South Africa.
